2. Scope of application

These General Terms and Conditions of Sale apply ipso jure, without restriction or reservation, to all sales made by POTTERY STAMP to consumer or non-professional purchasers (hereinafter referred to as the “CUSTOMER”) wishing to purchase the products offered for sale by the SELLER on its website https://www.potterystamp.com.

These General Terms and Conditions of Sale shall prevail, where applicable, over any other version or any other contradictory document.

In particular, these General Terms and Conditions of Sale apply to the exclusion of those applicable to other distribution or marketing channels for the SELLER's products.

The fact that one or other of the Parties does not claim the application of any clause of the General Terms and Conditions of Sale or acquiesces in its non-execution, whether permanently or temporarily, cannot be interpreted as a waiver by this Party of the rights which derive for it from the said clause.

POTTERY STAMP reserves the right to temporarily suspend its activity, in particular for vacations. During this period, the www.potterystamp.com website remains fully accessible, and orders can be placed, but will only be processed from the date of resumption of activity.
POTTERY STAMP will inform its customers at various points on the site of the vacation, its duration and the reason for it.

3. Acceptance and modification of the General Terms and Conditions

By ticking the box “I have read and accept the General Terms and Conditions of Sale” (or any other equivalent form), the CLIENT accepts these General Terms and Conditions of Sale, acknowledges full knowledge of them and waives the right to invoke any other conditions.

POTTERY STAMP reserves the right to modify its General Sales Conditions at any time. In this case, the applicable conditions will be those in force at the date of the CLIENT's order.

The new version of the General Terms and Conditions of Sale will not apply to transactions concluded previously.

4. Registration and Order

In order to purchase a PRODUCT, the CLIENT must be at least 18 years of age and have legal capacity or, if a minor, be able to justify the agreement of his/her legal representatives.

The CLIENT's registration on the SITE is free of charge.

The CLIENT's registration automatically leads to the opening of an ACCOUNT in their name, giving them access to a PERSONAL AREA that enables them to manage their PRODUCT ORDERS.

At the end of this process, the CLIENT will receive an e-mail confirming registration.

The CLIENT undertakes to create a single ACCOUNT on the SITE.

CUSTOMERS warrant that all information provided in the registration form is accurate, up-to-date and truthful, and is not misleading.

They undertake to update this information immediately in their PERSONAL AREA in the event of any changes, so that it always corresponds to the aforementioned criteria.

The CLIENTS are informed and accept that the information entered for the purposes of creating or updating their ACCOUNT constitutes proof of their identity. The information entered by CLIENTS is binding on them as soon as it has been validated.

CLIENTS can access their PERSONAL AREA at any time by entering their LOGIN CREDENTIALS.

The PERSONAL AREA enables the CUSTOMER to consult all his ORDERS made on the SITE, and also enables him, where applicable, to track the DELIVERY of PRODUCTS.

However, POTTERY STAMP undertakes to keep securely all contractual elements whose conservation is required by the law or regulations in force.

In the event of breach of these provisions relating to the registration of a CLIENT, POTTERY STAMP may send an e-mail to the CLIENT, giving it a period of seven (7) working days to comply with these provisions. This e-mail will indicate the grievances complained of and the obligations alleged to have been breached. At the end of this period, POTTERY STAMP may suspend the CLIENT's ACCOUNT. If the CUSTOMER fails to comply within a further period of seven (7) working days, POTTERY STAMP may cancel the CUSTOMER's ACCOUNT. In the case of current ORDERS, these must be paid for by the CUSTOMER and delivered by POTTERY STAMP.

This exclusion is not exclusive of the possibility for POTTERY STAMP to take legal action against the CUSTOMER, when justified by the facts.

The CLIENT, who wishes to place an order on the Internet site, must obligatorily :

- Login
- Fill in the order form
- View order summary
- Confirm your order (double-click principle).

Validation of the order implies express acceptance of all operations carried out on the website.

The sale will only be considered definitive once the SELLER has sent the CLIENT confirmation of acceptance of the order by e-mail, and once the SELLER has received payment in full.

Only special orders (weddings, christenings, communions, anniversaries, etc.) may be processed by post or e-mail.

Confirmation of acceptance of the order by the SELLER is accompanied by the standard withdrawal form mentioned in article 9 below.

5. Product characteristics and availability

Each product offered for sale by the SELLER is described on the website.

The CUSTOMER is informed that slight variations in tone in the photographic representation of products on the website may occur for reasons linked to the display modalities of his screen.

Product offers are subject to availability.

POTTERY STAMP is a retailer and does not sell large quantities of the products offered, except in the case of special orders (weddings, christenings, communions, birthdays, etc.). POTTERY STAMP reserves the right to refuse orders for large quantities of the same product, starting from 5 identical items. Special orders are processed outside the website, by direct contact between the buyer and POTTERY STAMP.

Our product offers are valid as long as they are visible on the site, within the limits of available stocks, except for promotional operations mentioned as such on the site. In the event of product unavailability after your order has been placed, we will inform you by e-mail. Your order will be automatically cancelled and your bank account will not be debited.

We undertake to refund or exchange any products that appear to be faulty, damaged or not corresponding to your order, if they have not been used. In this case, we would be grateful if you would make a detailed written statement and return the product(s) to us. POTTERY STAMP will proceed, at your choice, with the exchange or the refunding of the product(s). Shipping costs will be reimbursed on the basis of the invoiced rate and return shipping costs will be reimbursed upon presentation of receipts. In any case, you benefit from the legal guarantees of conformity and hidden defects.

The stipulations of this article do not prevent you from benefiting from the right of withdrawal provided for in article 9.

6. Prices

Products are supplied at the current prices shown on the site when the order is placed by the CLIENT. Prices are expressed in Euros, all taxes included, for metropolitan France.
As delivery countries have different tax rates, prices including all taxes will be recalculated and adjusted if necessary when the basket is validated.

These prices are firm and non-revisable during their period of validity, as indicated on the site of POTTERY STAMP.

POTTERY STAMP reserves the right to modify its prices at any time but the products will be invoiced on the basis of the prices in force at the time of your order validation.

The products remain the property of POTTERY STAMP until the complete payment of the price.

These prices do not include the expenses of delivery, which are invoiced in supplement.

7. Delivery

Packages are forwarded to the carrier 1-5 working days (depending on the number of orders) after receipt of your payment.

This is the time needed to prepare your order. As soon as possible, we will provide you with a link to track your package online.

Products will be dispatched within the time indicated when the order is placed, to the address indicated by the CLIENT when placing the order on the website. POTTERY STAMP is committed to manufacturing and shipping times and not to delivery times, the latter being the responsibility of the carrier chosen when the order was placed. POTTERY STAMP cannot be held responsible for late delivery due to the carrier.

They will be calculated according to the total price of the order.

Delivery means the transfer to the CLIENT of physical possession or control of the product.

The CLIENT is responsible for checking the condition of the products delivered.

In accordance with article L133-3 of the French Commercial Code, the CLIENT has a period of three days, not including public holidays, from receipt of the products to make any complaint to the carrier, by registered letter, concerning loss and/or damage to the parcel(s).

In the event of delay of forwarding emanating from POTTERY STAMP, an email will be addressed to you to inform you of a possible consequence on the deadline of delivery which was indicated to you. In any event, in accordance with legal provisions, in the event of a delay in shipment of more than 7 days, you have the right to cancel your order within 60 working days. In this case, if you have received the product after your cancellation, we will reimburse you for the cost of the product and the outward carriage costs, on receipt of the product by us, complete and in its original condition.

In accordance with the provisions of article L 138-2 of the French Consumer Code, in the event of failure by POTTERY STAMP to fulfil its obligation to deliver the goods on the date or at the end of the agreed delivery period, the CLIENT may terminate the contract, by registered letter with acknowledgement of receipt or by a written document on another durable medium, if, after having enjoined POTTERY STAMP, using the same methods, to make the delivery within a reasonable additional period, the latter has not complied within this period.

When the contract is terminated under the legal conditions, POTTERY STAMP will reimburse the CLIENT for all sums paid, at the latest within fourteen days of the date on which the contract was terminated.

8. Payment

The price is payable in full, in a single instalment, in accordance with the following terms and conditions:

Our site is protected by a security system.
We have adopted the SSL encryption process, but we have also strengthened all scrambling and encryption procedures to protect all sensitive data linked to means of payment as effectively as possible.

Credit card:
Visa - Mastercard
When you place your order, please indicate on the order form your card number, its expiration date and the last 3 digits on the back of your card (Cryptogram). Your account will be debited for the amount of your purchase when the order is dispatched.

PayPal:
You enter your PayPal login and password on your PayPal account, which you will be directed to when you confirm your order at the last stage of the order process (5. I place my order). PayPal is a secure, fast and free online payment service.

Payments made by the CUSTOMER will not be considered final until the SELLER has effectively collected the sums due.

POTTERY STAMP will not be held to proceed to the delivery of the products ordered by the CUSTOMER if this one does not pay him the price in totality under the conditions indicated above; POTTERY STAMP reserving the right, in the event of nonrespect of the conditions of payment appearing above, to suspend or cancel as of right the delivery of the orders in progress carried out by the CUSTOMER.

If the bank refuses to debit a card or other means of payment, the CLIENT must contact POTTERY STAMP's Customer Service Department in order to pay for the ORDER by any other valid means of payment.

In the event that, for any reason whatsoever, opposition, refusal or other, the transmission of the flow of money due by the CLIENT proves impossible, the ORDER will be cancelled and the sale automatically terminated.

9. Right of withdrawal

9.1 Right of withdrawal

Apart from the exceptions listed below, the CUSTOMER in principle has the right to withdraw by returning or returning the PRODUCT to POTTERY STAMP.

To do so, the PRODUCT must be returned or restituted without undue delay, and at the latest within fourteen (14) days following communication of the decision to withdraw.

9.2 Withdrawal period

In accordance with article L.221-18 of the French Consumer Code, the withdrawal period expires fourteen (14) days after the day on which the CLIENT, or a third party other than the carrier and designated by the CLIENT, takes physical possession of the PRODUCT.

If the CLIENT's order includes several PRODUCTS or if these PRODUCTS are delivered separately, the withdrawal period expires fourteen (14) days after the day on which the CLIENT, or a third party other than the carrier and designated by the CLIENT, takes physical possession of the last PRODUCT.

9.3 Notification of the right of withdrawal

In order for the withdrawal period to be respected, the CUSTOMER must transmit his communication concerning the exercise of the right of withdrawal before the expiration of the withdrawal period.

9.5 Effects of withdrawal

In the event of withdrawal by the CLIENT, POTTERY STAMP undertakes to reimburse all sums paid, including delivery costs (with the exception of additional costs resulting from the CLIENT's choice, where applicable, of a delivery method other than the less expensive standard delivery method proposed by POTTERY STAMP) without undue delay and, in any event, no later than fourteen (14) days from the day on which POTTERY STAMP receives the returned PRODUCT. POTTERY STAMP will proceed with the reimbursement using the same means of payment that the CLIENT used for the initial transaction, unless the CLIENT expressly agrees to a different means, in any case, this reimbursement will not incur any costs for the CLIENT.

POTTERY STAMP is not obliged to reimburse additional costs if the CUSTOMER has expressly chosen a delivery method that is more expensive than the standard delivery method offered by POTTERY STAMP.

POTTERY STAMP may defer reimbursement until receipt of the goods or until the CUSTOMER has provided proof of shipment of the goods, whichever comes first.

9.6 Return procedure

The CLIENT must, without undue delay and, in any event, no later than fourteen (14) days after communication of his decision to withdraw from this contract, return the goods to : POTTERY STAMP - 16 rue Jean Perrin 77176 SAVIGNY LE TEMPLE, FRANCE.

This period is deemed to have been respected if the CLIENT returns the goods before the fourteen-day period has expired.

9.7 Return costs

The CLIENT shall bear the direct costs of returning the goods.
No prepaid return vouchers will be issued.

9.8 Condition of returned goods

The PRODUCT must be returned in accordance with POTTERY STAMP instructions and include all accessories delivered.
The product must be returned in its original condition.
Inking units must be sealed as when they left our workshop.

The CLIENT shall only be liable for depreciation of the good resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the PRODUCT. In other words, the CLIENT may test the PRODUCT, but may be held liable if it carries out manipulations other than those necessary.

9.9 Exclusions from the right of withdrawal

The right of withdrawal is excluded in the following cases:

Supply of goods or services whose price depends on fluctuations in the financial market
Supply of goods made to the CLIENT's specifications or clearly personalized.
By their very nature, customizable products cannot be returned.
Supply of goods likely to deteriorate or expire rapidly after opening, such as inks.
Supply of sealed audio or video recordings or software which have been unsealed after delivery.

Newspaper, periodical, magazine (except subscription contracts)
Provision of accommodation services other than for residential purposes, transport of goods, car rental, catering or services related to leisure activities if the offer provides for a specific date or period of performance
Supply of goods which by their nature are inseparably mixed with other items
Supply of sealed goods which cannot be returned for health or hygiene reasons and which have been unsealed by the CLIENT after DELIVERY.
Supply of alcoholic beverages, the price of which has been agreed at the time of conclusion of the sales contract, delivery of which can only be made after 30 days, and the actual value of which depends on market fluctuations beyond the seller's control.
Supply of digital content not supplied in dematerialized form if performance has begun with the express prior consent of the consumer, who has also acknowledged that he will thereby lose his right of withdrawal.

10. Intellectual property rights

All elements of the SELLER's catalogs, whether visual or audio, including the underlying technology, texts, comments, works, illustrations, works and images reproduced or represented on the POTTERY STAMP site are strictly reserved under copyright and intellectual property law for the entire world. Any total or partial reproduction or representation of the POTTERY STAMP site or of all or part of the elements found on the POTTERY STAMP site is strictly forbidden.

Any total or partial reproduction of the content of the SELLER's catalogs is strictly forbidden and may constitute an infringement of copyright.

A CUSTOMER who has a personal Internet site may, for personal use on his site, place a simple link referring directly to the SELLER's site.

In all cases, the link may be removed at the request of POTTERY STAMP.

11. Warranties and liability

In addition to the commercial warranties that POTTERY STAMP may offer for certain PRODUCTS, all CUSTOMERS benefit from “legal” warranties, for all PRODUCTS, which are detailed below.

11.1 Warranty of conformity

Article L. 217-4 of the French Consumer Code: “POTTERY STAMP delivers goods in conformity with the contract and is responsible for any defects in conformity existing at the time of delivery.

He is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when the latter was made his responsibility by the contract or was carried out under his responsibility”.

Article L.217-5 of the French Consumer Code: “The good conforms to the contract:
1° If it is fit for the purpose usually expected of similar goods and, where applicable :
- if it corresponds to the description given by POTTERY STAMP and possesses the qualities that the latter presented to the buyer in the form of a sample or model;
- if it has the qualities that a purchaser may legitimately expect in view of the public statements made by POTTERY STAMP, the producer or his representative, particularly in advertising or labelling;
2° Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the purchaser, brought to the attention of the seller and accepted by the latter”.

POTTERY STAMP may be held liable for defects in conformity existing at the time of delivery, and for defects in conformity resulting from packaging, assembly instructions or installation when the latter has been made its responsibility or has been carried out under its responsibility.

Any action arising from a lack of conformity shall be barred after two (2) years from delivery of the PRODUCT. (Article L. 217-12 of the French Consumer Code).

In the event of a lack of conformity, the CLIENT may request replacement or repair of the PRODUCT, at its option. However, if the cost of the CLIENT's choice is manifestly disproportionate to the other possible option, taking into account the value of the PRODUCT or the importance of the defect, POTTERY STAMP may proceed with a refund, without following the option chosen by the CLIENT.

In the event that replacement or repair is impossible, POTTERY STAMP undertakes to refund the price of the PRODUCT within thirty (30) days of receipt of the returned PRODUCT and in exchange for the return of the PRODUCT by the CLIENT to the following address: POTTERY STAMP - 16 rue Jean Perrin 77176 SAVIGNY LE TEMPLE.

Finally, the CLIENT is exempted from proving the existence of a defect in the conformity of the PRODUCT during the twenty-four (24) months following delivery of the PRODUCT, except for second-hand goods for which this period is fixed at six (6) months (Article L.217-7 of the French Consumer Code).

It is specified that the present legal warranty of conformity applies independently of the commercial warranty granted, if any, on the PRODUCTS.

11.2 Warranty against hidden defects

POTTERY STAMP is bound by the warranty for latent defects in the PRODUCT sold which render it unfit for its intended use, or which impair this use to such an extent that the CLIENT would not have purchased it, or would only have paid a lower price for it, had he known of them (Article 1641 of the French Civil Code).

This warranty allows the CLIENT, who can prove the existence of a latent defect, to choose between reimbursement of the price of the PRODUCT if it is returned, or reimbursement of part of its price if the PRODUCT is not returned.

In the event that replacement or repair is impossible, POTTERY STAMP undertakes to refund the price of the PRODUCT within thirty (30) days of receipt of the returned PRODUCT and in exchange for the return of the PRODUCT by the CLIENT to the following address: POTTERY STAMP - 16 rue Jean Perrin 77176 SAVIGNY LE TEMPLE.

The action resulting from redhibitory defects must be brought by the CLIENT within two (2) years of the discovery of the defect. (Paragraph 1 of Article 1648 of the French Civil Code).

12. Liability

POTTERY STAMP may not be held liable in the event of non-performance or improper performance of contractual obligations attributable to the CUSTOMER, in particular when entering his ORDER.

POTTERY STAMP cannot be held responsible, or considered to have failed in its obligations, for any delay or non-fulfilment, when the cause of the delay or non-fulfilment is linked to a case of force majeure as defined by the jurisprudence of the French courts and tribunals.

It is further specified that POTTERY STAMP has no control over websites that are directly or indirectly linked to the SITE. Consequently, POTTERY STAMP accepts no liability for the information published on these sites. Links to third-party websites are provided for information purposes only and no guarantee is given as to their content.

Finally, the CLIENT undertakes in any event to take note of the precautions for use of the PRODUCT delivered, mentioned on the PRODUCT or on its packaging. POTTERY STAMP shall not be held liable for any inconvenience or damage directly or indirectly related to the abnormal use of a PRODUCT.

13. Force majeure

POTTERY STAMP cannot be held responsible if the non-execution or the delay in the execution of one of its obligations described in the present GTCS results from a case of force majeure.

Force majeure in contractual matters occurs when an event beyond the debtor's control, which could not reasonably have been foreseen when the contract was concluded and whose effects cannot be avoided by appropriate measures, prevents the debtor from fulfilling his obligation.
If the impediment is temporary, performance of the obligation is suspended unless the resulting delay justifies termination of the contract.If the impediment is definitive, the contract is terminated ipso jure and the parties are released from their obligations under the conditions set out in articles 1351 and 1351-1 of the French Civil Code.

In this respect, POTTERY STAMP may not be held liable in particular in the event of an attack by hackers, unavailability of materials, supplies, spare parts, personal or other equipment, interruption of electronic communications networks, or in the event of any circumstance or event beyond the control of POTTERY STAMP occurring after the conclusion of the GCS and preventing performance under normal conditions.

It is specified that, in such a situation, the CUSTOMER may not claim the payment of any compensation and may not bring any action against POTTERY STAMP.

In the event of one of the aforementioned events, POTTERY STAMP will endeavor to inform the CLIENT as soon as possible.


14. Protection of personal data

In accordance with the French Data Protection Act 78-17 of January 6, 1978, we remind you that the nominative data requested from the CLIENT is necessary for the processing of the order and, in particular, for the preparation of invoices.
In accordance with current national and European regulations, the CLIENT has the right to permanent access and rectification of information concerning him/her.

Please indicate your surname, first name, e-mail address and, if possible, your customer reference number. In accordance with current regulations, your request must be signed and accompanied by a photocopy of an identity document bearing your signature, and specify the address to which you would like a reply.A reply will be sent to you within 2 months of receipt of the request.
The CLIENT may also, for legitimate reasons, object to the processing of data concerning him/her.

The CLIENT may receive commercial offers from POTTERY STAMP for products similar to those ordered.

The computerized registers, kept in the computer systems of POTTERY STAMP under reasonable conditions of security, will be considered as proof of communications, orders and payments between the parties.

It is expressly agreed that, in the absence of proof to the contrary, the data stored in POTTERY STAMP's information system has evidential value with regard to orders placed by the CUSTOMER. Data on computer or electronic media constitute valid proof and as such are admissible under the same conditions and with the same probative force as any document drawn up, received or kept in writing.

Purchase orders and invoices are archived on a reliable and durable medium so as to correspond to a faithful and durable copy in accordance with article 1348 of the French Civil Code.
E-mails, postcards and faxes are also considered as perfect proof.

Transfers of personal information outside the EU
We may potentially store and process your information via third-party hosts located in the United States or other countries. We may therefore transfer your personal information to a jurisdiction where data protection and governmental oversight legislation is different from that of your country. If we need to transfer your personal information outside the European Union, we rely on the Data Protection Shield (“Privacy Shield”) as the legal basis for this, with Google Cloud benefiting from Privacy Shield certification.

Your rights:

- Access. You may have the right to access and receive a copy of the personal information we hold about you by contacting us. You will find our contact details below.

- Modify, restrict, delete. You may also have the right to amend your personal information, restrict our use of it or delete it. Other than in exceptional circumstances (e.g. if we need to retain store data for legal reasons), we will usually delete your personal information on request.

- To object. You may object 1) to us processing certain of your information for our legitimate interests and 2) to receiving marketing messages from us after you have explicitly consented to receive them. In such cases, we will delete your personal information unless we have legitimate grounds for continuing to use it, or in cases where it is required for legal reasons.

- Complaints. If you live in the European Union and wish to raise a concern about our use of your information (and without prejudice to any other rights you may have), you can do so with your local data protection authorities.

15. Applicable law

By express agreement between the Parties, the present General Terms and Conditions of Sale and the purchase and sale transactions arising therefrom are governed by French law.
POTTERY STAMP products comply with the regulations in force in France.
The language of this contract is French.

However, prior to any recourse to an arbitral or state judge, the CUSTOMER is invited to contact POTTERY STAMP's complaints department.

In accordance with article L.612-1 of the French Consumer Code, the consumer must have access to a consumer mediation system for the amicable resolution of any dispute.

In accordance with articles L.616-1 and R.616-1 of the French Consumer Code, the contact details of the competent mediators are as follows: Center de la Médiation de la Consommation de Conciliateurs de Justice.
